El escenario judicial y arbitral internacional en el conflicto Ucrania-Rusia

Abstract

The article analyzes the Ukraine-Russia conflict from the perspective of the broad judicial and arbitration scenario that has opened up with its existence. For this, the different positions of both parties before international jurisdictions such as the European Court of Human Rights, the International Court of Justice and arbitration tribunals are described and argued. At this point, the role of the International Criminal Court is also discussed and the possible ways that arise in jurisdictional matters before the alleged commission of crimes that are the competence of this court through its Statute. Among the matters that are disputed before these courts are facts that affect human rights, the legal regime of marine spaces between Ukraine and Russia, among others.
