A “de facto” solidarity: the creation of the european trademark system

Abstract

The evolution of the European project, since the Schuman Declaration of 1950, has been taking place through the development of “de facto solidarities” between the Member States on different areas. One of them, closely linked to the establishment of the internal market, was the creation of a European system of trademarks, which allows the registration and protection of those IP rights throughout the territory of the European Union and coexists with and informs the national trademark systems. This article examines the way it functions and its characteristics, as well as the impact of the european case-law.

Law Degree student (UNED). Official of the Superior Corps of State Civil Administrators. General Director of the Spanish Patent and Trademark Office, O.A. (2018-2022), Ministry of Industry, Commerce and Tourism. He is currently Minister of Industry and Tourism at the Permanent Representation of Spain to the European Union (Brussels).
