Foreclosure and Dation in Payment in the Event of Default by the Mortgagor: Legal Analysis and Implications with Respect to the Sustainable Development Goals of the 2030 Agenda

The mortgage foreclosure procedure has been questioned in situations of economic crisis that affect debtor individuals. The strict application of the principle of universal patrimonial liability can lead to the loss of the main residence without this implying the total cancellation of the outstanding debt. This fact has prompted the search for more balanced legal solutions, which make the effectiveness of credit compatible with the protection of fundamental rights.
