Résumé

El artículo examina la fijación dinámica de precios mediante sistemas de aprendizaje por refuerzo multiagente y su incidencia en la configuración de la práctica concertada del artículo 101 TFUE. Analiza el alcance jurídico del contacto como criterio de subsunción de las interacciones recíprocas entre sistemas de fijación dinámica de precios basados en aprendizaje por refuerzo multiagente en la categoría de práctica concertada. Con tal finalidad, desarrolla un análisis dogmático y probatorio del artículo 101 TFUE y de la jurisprudencia del Tribunal de Justicia de la Unión Europea, contrastado con la arquitectura técnica y la evidencia empírica disponible sobre el aprendizaje por refuerzo multiagente aplicado a la fijación dinámica de precios. El análisis sostiene que el contacto admite una reinterpretación funcional cuando las señales procesadas por los sistemas MARL reducen la incertidumbre estratégica de forma no explicable por la mera adaptación autónoma al mercado y fundamenta un criterio de subsunción sustentado en una presunción iuris tantum basada en factores técnicos y un modelo de atribución empresarial.
